Is The International Criminal Court's Credibility Undergoing A Test?

  • By: Tarig Mubarak

Many are questioning the timing of the court.

The recent incidents in Khartoum when the opposition parties tried to confront the government by demanding a fare and transparency elections and how the government responded and how it managed to contain and halt the signs of resistance, shows how the Sudan government is determined to  win the election.  Ethical or not it does not matter for the Sudan government which tools they employ in their march towards an election victory.

A strong tendency for separation within the South of Sudan political parties is showing up and not concerned with Darfur and the rest of the North of Sudan fate.

The differences and continuous clashes between the rebels groups in Darfur and the shift of the international community attention towards the South of Sudan has withdrawn Darfur issue towards the bottom of the urgent agendas of the international community concerning Sudan.

The lack of the International criminal court of powers to follow up the ruling as it was described by  Ocampo himself when he states that the reason he pursued the appeal was that he wanted the world to “know what happened”, since “it is important for the victims”.

The success of the Sudanese government to employ the Sudanese passions creating a feeling among most of the Sudanese opposing to repeat what many describe as the “Shame of how Sadam Hussein” case was handled.

The declaration of the two main traditional parties in Sudan that should they win the elections they would not comply with the court order of arresting and handing al Bashir.

All above facts in my view are against the credibility for not only the International Criminal Court, but the difficult position the whole international community would face in the months to come.

Hence, without having any doubts of the atrocities committed by Al Bashir in many regions of the Sudan many even ordinary people are questioning the timing of the court and how the whole case was handled.

Should Al Bashir win the election, then the International criminal Court has helped creating a hero out of a criminal.
